Is Ibogaine Legal? Status by Country

Nearly everything written about ibogaine’s legality sorts countries into legal and illegal. That division is wrong often enough to be dangerous, because it puts “you may be prescribed this by a doctor” and “nobody has got around to regulating it” in the same box.

Six categories cover it. Several jurisdictions are hybrids, and the instrument column is where that shows. The distinction that matters most to a reader planning something is the second one. “Prescription medicine” is routinely reported as “legal”, including by the AI summary Google currently shows for this query. It means a physician may prescribe it, on their own responsibility, for a drug no regulator has approved. Finding one who will is a separate problem from the law.

Status by jurisdiction

Official means we read the regulator or the statute itself. Compiled means the entry rests on a secondary compilation and is queued for verification. Where we read the instrument that ought to name it and found nothing, the instrument column says so, because a sourced absence is a finding and not a gap.

The United States, state by state

The table above gives one row to a country where nine legislatures have moved in eighteen months, so the American picture needs unpacking separately. None of it changes the federal schedule, which is the point most often lost.

The federal position sets out what Schedule I actually does and carries the comparison table. Texas put up $50 million, failed to attract a drug developer it judged adequate, and handed the work to its own medical schools. Arizona put up $5 million and awarded it to Barrow Neurological Institute in August 2026, the only state grant to go to a single named institution rather than to a consortium. Kentucky enacted its framework over a governor’s veto in April 2026, having lost its $42 million in committee three weeks before final passage. Oklahoma copied Kentucky’s mechanism almost clause for clause a month later, without money. Mississippi is the only state to write cardiac screening into its enabling law. And Colorado is the only one that did something categorically different: it decriminalised personal possession by ballot measure in 2022, and requires a benefit-sharing plan with the communities the plant comes from.

What a status actually restricts

A schedule entry is not a single prohibition. It is a set of separate permissions, and a country can grant some and withhold others. Reading a status means asking which of the five it covers.

Possession. Holding the substance. The United States criminalises it, the United Kingdom does not, Portugal handles it administratively. This is the permission most often reported as if it were the whole answer.

Supply. Giving or selling it to someone else, including without payment. Prohibited nearly everywhere, including in countries where possession is not. Finland is the clearest case of the gap, and the mechanism is worth naming: ibogaine is not a narcotic there but sits on the list of psychoactive substances banned from the consumer market, and §23b of the Narcotics Act prohibits manufacture, import, storage, offering for sale and supply. Possession appears nowhere in that sentence. You may hold it, and no one may lawfully give it to you.

Import and export. Almost always a separate offence, and almost always present even where the domestic rules are permissive. See crossing a border.

Administration. Giving it to another person, which in a prescription country is what the prescriber’s authority covers and what a lay facilitator’s does not. A retreat in an unscheduled country may be committing no drug offence and still be practising medicine without a licence.

Manufacture and cultivation. Producing the alkaloid or growing the plant. Often treated separately again, and the whole subject of Gabon’s 2026 decree, which subjects harvest, research, processing and export alike to prior authorisation rather than to a drugs schedule.

Where the reported picture is wrong

Seven claims circulate widely enough to be worth correcting on their own. We published three of them ourselves before reading the primary text.

“The Netherlands allows ibogaine treatment.” Ibogaine is not on the Opium Act lists, which is why products are sold there online. It is not an approved medicine, and in 2024 the national public health institute, at the request of the health ministry, assessed those products and advised consumers not to use them, citing heart-rhythm disturbance and deaths including in the Netherlands. An absence of scheduling is not an endorsement, and here the state has said so in writing.

“Ibogaine is legal in Australia, Finland, New Zealand and Uruguay.” This sentence, from a widely read addiction charity, is wrong three times in four. Australia lists ibogaine in Schedule 4 of the Poisons Standard and New Zealand gazetted it as a prescription medicine in 2010, which makes both prescription-only rather than available. Finland bans it from the consumer market, so supplying it is an offence there. Only Uruguay is right, and only in the narrow sense that the substance is unscheduled, which is not the claim the sentence is making.

“Portugal decriminalised it.” Portugal decriminalised possession of the substances in the tables to Decree-Law 15/93. Ibogaine is not in them, and it is not on the newer list of psychoactive substances either. An unscheduled substance cannot be decriminalised, and the label has been travelling from one compilation to the next on the strength of Portugal’s reputation rather than its statute.

“Possession is illegal in the United Kingdom.” Under the Psychoactive Substances Act 2016, production, supply, offering to supply, possession with intent to supply, import and export are offences carrying up to seven years. Simple possession is not an offence, except inside a custodial institution. The distinction is the whole design of that Act.

“There is no lawful route in the United Kingdom.” We published this ourselves. A UK doctor may order an unlicensed medicine, a “special”, under regulation 167 of the Human Medicines Regulations 2012, and Schedule 2 to the Psychoactive Substances Act exempts both the prescriber and the patient. Nobody appears to have used it for ibogaine and the clinical threshold is high, but “nobody has walked it” is a different statement from “it does not exist”. “Texas has legalised ibogaine.” It has not. A state appropriation funds research. Federal scheduling is untouched by it, and no state can reschedule a federally controlled substance.

“No US state has decriminalised ibogaine.” One has. Colorado’s Proposition 122, approved by voters in 2022, decriminalised personal use and possession of ibogaine under state law. The federal offence is unaffected, and there is still no lawful supply, but the claim that no state has moved is wrong. Crossing a border is the part people get wrong

The status of a substance where you are going says nothing about the status of carrying it there.

Import and export are separate offences in most of the frameworks above, including several where domestic possession attracts no penalty. A country that has never scheduled ibogaine may still seize it at the airport under general medicines or customs rules, because an unapproved medicine crossing a border is a customs question before it is a drugs question.

Singapore is the case that should change how you plan a trip. Since 1 June 2024 the Misuse of Drugs Act has caught any substance “that has the capacity to have a psychoactive effect on an individual”, other than those specifically excluded, without naming it. Ibogaine is not in Singapore’s First Schedule and does not need to be. Part 2A then makes trafficking, manufacture, import, export and, at section 11I, possession and consumption offences. Section 11J goes further and reaches consumption outside Singapore by a citizen or permanent resident.

Read that against the United Kingdom, whose Act uses almost the same effect-based definition and deliberately left possession out. Two countries borrowed the same drafting idea and reached opposite conclusions about the person holding the substance. Changi is one of the busiest transit airports in the world, and a traveller who reasoned from the British design would be wrong there in the most consequential way available.

Why the law says what it says

Ibogaine’s prohibition predates any finding about its safety: Congress named it in Schedule I on 27 October 1970, decades before the cardiac mechanism was understood. And because it is absent from the Green List of substances under the 1971 Convention, no country was ever obliged to follow, which is why the table above is so uneven.

What makes a status change

Four mechanisms move these entries, and they move at very different speeds.

A regulator reclassifies. The fastest route, and the one behind most of the prescription-medicine entries above. A medicines agency decides that a substance being used unsupervised is better placed under a prescriber’s control. Canada in 2017 and New Zealand in 2010 both arrived that way, and neither required a vote.

A legislature acts. Slower, more visible, and currently the noisiest channel in the United States. Note what it has actually produced so far: money for research, not a change of schedule. The two are routinely conflated by people with an interest in the confusion.

A treaty adds the substance. Ibogaine is not in the 1971 Convention. If it were ever added, the countries where nothing has happened would be obliged to act, and the unscheduled column would empty quickly. Nothing suggests this is imminent.

An approval arrives. The mechanism nobody has used yet. If a regulator approved an ibogaine medicine on the strength of a completed trial, the question would stop being about schedules and start being about labels and indications. That is the change that would make this page obsolete, and it is years away at best.

The practical consequence for a reader: a status you checked a year ago is worth re-checking, and a status a clinic quotes you is worth checking against the regulator rather than against the clinic.

How we keep this current

This page carries the date we last checked these entries, at the top, and it goes stale in public after six months. Legal status on this subject is moving faster than it has in fifty years: state legislatures are funding research, regulators are being asked to reconsider, and at least one country revisits its position most years.
